Florida Boating Personal Injury Attorney
FORT LAUDERDALE, FL (AttorneyNewswire.com) — February 16, 2011 — A Highland Beach, Florida boater whose propeller sliced a scuba diver near the Boca Inlet has been charged with culpable negligence and careless operation resulting in a boating accident. The boater was also cited for failing to stay at least 300 feet away from a “diver down” flag. The accident occurred on January 22nd, 2011. State Law requires that boaters stay at least 100 feet away from scuba divers’ flags within a river, inlet or channel. In open waters, boaters must make a reasonable effort to stay 300 feet away from the divers’ flags. Within that area, boaters must move at reasonable speeds. According to the Florida Fish and Wildlife Commission, between 2004 and 2009, 22 scuba divers were injured or killed when run over by a boat in Florida.

The boater, 64, lives in Highland Beach and Wilmington, Delaware. He was driving a 28-foot Sea Fox powerboat. The scuba diver was a 46-year-old male. February 14, 2011 — Summer Infant Incorporated, a company that makes infant health and safety products, has recalled 1.7 million baby monitors, according to the U.S. Consumer Product Safety Commission. The recall was apparently done as the result of two recent deaths associated with the video baby monitors. In Washington, a 10-month old girl died of strangulation caused by the cords of a video baby monitor on March 10, 2010. In South Carolina, a 6-month old boy died of strangulation caused by the cords of a monitor that was placed on a changing table in November, 2010.

Snow Causes Wisconsin Trouble
The worst moment for Sarah Cassity, 26, of Trevor, Wis., who was stuck overnight on County SA north of Antioch, was when the Kenosha County Sheriff called her back.
“It was about 1 a.m. and they called back to say they were canceling the help call because there was no way they could get to her,” said Cassity. The sheriff’s vehicles were either also stuck or trying to rescue someone else.
“I was freezing, but I wasn’t dying (they asked if she needed a ambulance, but she declined). I didn’t realize how serious it was,” she said.
She got into the problem because she was working at Walgreens in Antioch and the staff there was waiting for corporate approval to leave early. But they never received an e-mail because the people in the corporate office had themselves gone home early.
Cassity left work a little after 10 p.m. Driving north through Antioch was OK, but conditions changed at the state line.
“I couldn’t tell if I was on the right side of the road, and I couldn’t see anything. It was completely white,” she said.
A truck passed her at one point and she missed her turnoff, so she took the next road, County SA. She drove about a quarter of a mile before getting stuck. Her car had an OnStar onboard emergency link, and OnStar personnel were able to calm her down.
“If you don’t have it you should,” she said. “I was sobbing and crying, They were the best.”
She rationed her gas, turning the car on every hour for 10 minutes. Her car has a gauge that estimates remaining fuel in miles. She started at 60 miles and was rescued at 11.
“My mother even went on Facebook to see if someone would go get me, and two people tried,” Cassity said. She could hear one truck, but he couldn’t see her. Another man tried to get to her with a snowmobile, but he got stuck twice.
“There were times I was so cold,” she said. Finally, after over 10 hours, a snow plow associated with the fire department made it to her and drove her home to husband, Brian, and her two children, Josh, 4, and Emilee, 18 months.
“It was very lonely and very scary. It took something out of me. It was a really bad experience,” she said. “Now I’m home with my family,” she said.
Trevor Church, 23, of Mundelein was part of the nightmare on Peterson Road where Grayslake and Round Lake-area firefighters and police and snow plow crews had to rescue more than 100 stranded motorists.
He stayed at the Fremont Township offices, one of three emergency shelters that were opened, after being stuck in his car for a couple of hours. He was coming home from a friend’s house in Fox Lake around 7 p.m.
Church didn’t leave the shelter until the next day when state Rep. Ed Sullivan, R-Mundelein, picked him up. Church’s mother and Sullivan’s wife work together, and he helped get a truck to Church and a ride to the shelter.
“I slept on a foldout table with a Brawny (paper towel) roll as a pillow,” he said.
“There were 40 people there,” he said, with more coming in throughout the night. “There were elderly people and people with little kids. It was pretty chaotic,” he said.
The snow drifting while he was in the car was incredible. One couple had to climb through their window because they could not open their car door.
He went to retrieve his vehicle from Mac Truck, which also runs Northern Towing, which charged him $285 for a tow of about 1,000 feet.
“But something was wrong with the wheels, so I pulled into Target (near Mundelein) and had it towed to the mechanic,” he said, and paid another $80.
But he made it home. “It was quite a scene,” he said.
Peter Tekampe, Fremont Township supervisor, said he got to township center to open it as an overnight shelter by driving his tractor with a cab because his vehicles were drifted in his garage.
“It was about a mile and a half,” he said, and the cab was heated. “We used the food pantry food to feed people. We had bodies all over,” he said, referring to the township office and the highway department offices. “There were 80 to 90 people all together. There were no bad attitudes.”
In Antioch, St. Raphael the Archangel Catholic Church on Route 173 was used as an overnight shelter after a truck jack-knifed near Crawford Road and blocked Route 173.
“We had about 40 cars stuck (on Route 173),” said Fire Chief John Nixon. “For the most part it was handled well,” he said. “We also had the senior center for people who were without power,” he said, because part of the village lost power.
“Everyone was working at maximum capacity,” he said.
In addition, the Wal-Mart Super Center on Route 173 was closed because of concern that the snow load from the blizzard might collapse the roof. Contractors were called to clear it.

Texting While Driving a No No
Although Florida car accident deaths may have dropped in 2010, more steps can be taken to protect the state's motorists, such as a ban on texting while driving, South Florida personal injury lawyer Robert Gordon said this week.
“I'm encouraged to see traffic fatalities have significantly dropped, but we can do better,” Gordon said, reacting to preliminary 2010 numbers released this month by the Florida Department of Highway Safety and Motor Vehicles.
“Drunk driving remains a problem, and distracted driving has become a serious public safety issue,” said Gordon, a founding attorney of the Palm Beach Gardens personal injury law firm of Gordon & Doner.
“States across the country have enacted bans or curtailed texting while driving,” Gordon said. “Florida should follow their lead.”
Even though 2,430 people died in Florida car accidents in 2010, the total marked the lowest number of traffic fatalities the state has seen since 1978, according to Florida officials.
In a news release, the, Florida Highway Patrol director John Czernis credited law enforcement efforts and increased seat belt use as factors causing the decline.
However, drunk driving accident deaths remain high in the state. According to National Highway Traffic Safety Administration statistics, out of the 2,558 traffic fatalities in Florida in 2009, 770 involved alcohol-impaired driving. Only California and Texas had higher numbers.
Additionally, Gordon points to a recent NHTSA report showing that 5,474 people were killed and a staggering 448,000 were injured nationally in 2009 in distracted driving accidents. Out of those numbers, 995 distracted driving deaths and 24,000 injuries were traced to cell phone use.
Florida has no laws banning the use of hand-held or hands-free cell phones while driving. A bill to ban texting while driving didn't make it through the legislature last year.
“Distracted driving can be as dangerous to other motorists as drunk driving,” said Adam Doner, an experienced Florida car accident attorney and co-founding partner of the law firm.
“It takes the driver's attention off the road, and it leads to reckless driving , such as speeding, following too closely or braking too late,” he said.
In coming months, Doner said the state's traffic safety advocates would track two bills pending in the Florida legislature: H.B. 79 and S.B. 158.
Both bills would make it a secondary violation to use a “wireless communication device” while operating a motor vehicle and are aimed at reducing car accidents, injuries and deaths as well as medical care and insurance costs.
“As a personal injury lawyer who has worked hard to protect the rights and interests of car accident victims and their families throughout Florida, I would like to see us do all we can to prevent distracted driving accidents,” Gordon said. “A ban on texting is one way to do that.”

Additionally, Gordon points to a recent NHTSA report showing that 5,474 people were killed and a staggering 448,000 were injured nationally in 2009 in distracted driving accidents. Out of those numbers, 995 distracted driving deaths and 24,000 injuries were traced to cell phone use.
Florida has no laws banning the use of hand-held or hands-free cell phones while driving. A bill to ban texting while driving didn't make it through the legislature last year.
“Distracted driving can be as dangerous to other motorists as drunk driving,” said Adam Doner, an experienced Florida car accident attorney and co-founding partner of the law firm.
“It takes the driver's attention off the road, and it leads to reckless driving , such as speeding, following too closely or braking too late,” he said.
In coming months, Doner said the state's traffic safety advocates would track two bills pending in the Florida legislature: H.B. 79 and S.B. 158.
Both bills would make it a secondary violation to use a “wireless communication device” while operating a motor vehicle and are aimed at reducing car accidents, injuries and deaths as well as medical care and insurance costs.

Drivers Beware of Winter
Winter is showing no signs of letting up as it batters Pennsylvania and the Northeast, and motorists must be ready for the physical and legal hazards the harsh weather brings, says Pennsylvania personal injury attorney J. Christopher Munley.
“Bad weather makes for bad accidents,” said Munley, the managing partner of Munley, Munley & Cartwright, P.C., a Scranton, Pennsylvania personal injury law firm that represents car accident victims throughout the region.
“Drivers need to be extra careful and extra alert,” Munley said. “But if accidents happen, know the law, your obligations and your rights.”
According to Munley, any driver involved in a car accident should get the insurance information on other vehicles involved, collect eyewitnesses’ names and obtain a police report.
But, he said, those steps should be followed by a consultation with an experienced Pennsylvania car accident attorney as soon as possible.
“For most drivers, an accident is a rare or first-time event. They may collect the right information but fail to realize their rights or their liabilities. A lawyer’s advice is crucial,” Munley said.
Should an auto accident occur, Munley said all motorists should follow these basic steps:
Stay calm, turn off the ignition and turn on the emergency flashers.
Render aid and call an ambulance. Do not move injured people if movement could add to the injury.

If there is the slightest chance of injury, see a doctor. Serious injuries do not always result in immediate pain.
Notify the car's insurer and report the accident. Pennsylvania law requires that an accident report be filed within two days after an accident. An insurance company or the police department can provide the standard form.

Turn on your headlights.

Keep windows and mirrors free of snow and ice.
During whiteouts, come to a complete stop only when you can safely get as far off the road as possible or when there is a safe area to do so.
Do not stop in the flow of traffic since this could create a chain-reaction collision.
Do not pass a vehicle moving slowly or speed up to get away from a vehicle that is following too closely.
Always buckle up and never drink and drive.

Medical Records Company Purchased
ExamWorks Group, Inc. (NYSE: EXAM), the nation's leading provider of independent medical examinations (IMEs), peer reviews, bill reviews and related services, announced today that the Company has entered into a definitive agreement to acquire all of the outstanding stock of MES Group, Inc. (MES). MES, based in The Woodlands, Texas, provides independent medical examinations, peer reviews and utilization reviews to the automotive, disability, liability and workers' compensation markets. The acquisition excludes MES' Veterans Evaluation Services business. For 2010, the IME and peer review divisions of MES are expected to have approximately $129 million in annual revenue. ExamWorks would have had pro forma revenue of approximately $270 million and estimated pro forma adjusted EBITDA of approximately $51.8 million for the nine months ended September 30, 2010 if the MES acquisition and all other acquisitions by ExamWorks during 2010 occurred on January 1, 2010. Excluding MES, ExamWorks had pro forma revenue and adjusted EBITDA of $170.4 million and $34.2 million, respectively, for the nine months ended September 30, 2010. The transaction which is expected to close in the first quarter of 2011 is subject to customary closing conditions and regulatory approval.
Under the terms of the agreement, the purchase price is approximately $210 million and consists of $175 million of cash consideration, 1,424,501 shares of ExamWorks stock with a contractual value of approximately $25 million and up to $10 million of assumed debt. ExamWorks intends to finance the cash portion of the transaction using cash on hand and the Company's senior revolving credit facility. We expect the acquisition to be accretive to EBITDA and cash earnings.
