Bard, Inc. liable for injuries suffered by plaintiffs Christopher and Laure Thorpe as a result of the negligent design of the Composix® Kugel® Mesh hernia repair patch and the failure to warn of the dangers associated with the patch. Represented by Motley Rice attorney Don Migliori and co-counsel Ernie Cory of Cory, Watson, Crowder & DeGaris, P.C., the plaintiffs were awarded $1.3 million by the jury for personal injury damages and another $200,000 for loss of consortium.
The case, Christopher Thorpe and Laure Thorpe v. Davol, Inc. and C.R. Bard, Inc., was the second case to go to trial out of thousands of cases filed against Composix® Kugel® Mesh hernia patch manufacturer Davol and parent company C.R. Bard in MDL No. 07-1842 ML, Rhode Island federal court's first consolidated multidistrict litigation (MDL). The verdict comes after a Rhode Island jury found the same defendants negligent in the design of the hernia patch in the first tried case (In Re: Kugel Mesh Hernia Patch Litigation, MDL Docket No. 1842, No. 07-1842, John Whitfield v. Davol, Inc., et al., No. 07-1918, D. R.I.). Before Chief Judge Mary M. Lisi, it was argued that Mr. Thorpe suffered severe internal injuries caused by a broken plastic ring on the hernia repair mesh, including an abdominal wall abscess and fistula.
"It's unfortunate that these companies so repeatedly failed to accept responsibility for the damage caused by their product, and what we saw here today was justice," said Motley Rice attorney Don Migliori, who represents the plaintiffs and is co-lead counsel and liaison counsel in the hernia patch MDL. "The jury analyzed the objective facts to ultimately arrive at a just result, and we commend its decision to hold both Davol and C. R. Bard accountable."
Mr. Thorpe's injuries required him to undergo multiple surgeries to repair the damage caused by the defective hernia patch, injuries from which he continues to suffer due to the serious nature of the physical damage caused by the patch. The jury found that the defendants proximately caused Mr. Thorpe's injuries by failing to provide adequate warning or instruction for the hernia repair patch and acting unreasonably in designing the patch. The jury also found that the defendants' negligence proximately caused Laure Thorpe to lose the consortium of her husband as a result of his injuries and subsequent physical and emotional suffering.
"Today was an important day for my family and me," said plaintiff Christopher Thorpe. "We would like to express our gratitude to God for our attorneys and their constant efforts throughout this trial, for the many other attorneys who worked behind the scenes, and for the jury, whose verdict restored our faith in the U.S. justice system. We believe that this jury is sending a strong message to companies producing harmful products - that they can and will be held accountable."
Between December 2005 and March 2006, specific lot numbers of defective Composix® Kugel® Mesh hernia repair patches were recalled after it was found that the memory recoil ring, which opens the patch, could potentially break under the stress of placement in the intra-abdominal space and lead to chronic intestinal problems such as bowel perforations and chronic intestinal fistulae (abnormal connections or passageways between the intestines and other organs). Thousands of patients across the country ultimately filed lawsuits against Davol and Bard after suffering a wide array of serious medical complications allegedly caused by the defective patches. The lawsuits were eventually consolidated in In Re: Kugel Mesh Hernia Patch Products Liability Litigation (MDL Docket No. 1842, No. 07-1842, D. R.I.) in 2007.
The two remaining cases ((MDL Docket No. 1842, No. 07-1842, D. R.I.) selected for early bellwether trials in the federal Composix® Kugel® hernia patch litigation are scheduled to begin in November 2010 and January 2011.

Girl Wins Her Personal Injury Case
Aug 18, 2010 – A young girl who trapped a finger in a cupboard door at a Staffordshire pub has been awarded £3000 in compensation for her personal injury.
Seven-year-old Caitlyn Ratcliffe was playing in the Wacky Warehouse section of the Plough Inn in Alsager, during a birthday party held for one of her friends in February last year.
A Plough Inn staff member who was working in the area moved away from a cupboard door, which then shut automatically and trapped Caitlyn’s middle finger in the process.
The fractured finger on Caitlyn’s right hand was placed in a splint for three months, which caused problems for her at school as she was unable to write in her books. Caitlyn also needed a course of antibiotics after the injury became infected.
Caitlyn’s parents brought a case against Punch Taverns, which owns the Plough Inn, and last week Stoke-on-Trent County Court ruled in their favour. The money will now sit in a trust fund until Caitlyn is 18.
A spokesman for Punch Taverns said: “As a responsible operator, our main priority is to ensure that our pubs provide safe and welcoming environments for all our guests.
“A full internal investigation was completed and we are pleased a resolution has been reached.”

Houston DUI Attorney
The risk of being arrested for driving drunk will increase throughout Texas in coming weeks as law enforcement officials ramp up their efforts through the Labor Day holiday to crack down on impaired driving.
In addition to criminal charges, drivers should also realize the serious civil consequences they face if they get behind the wheel while impaired by alcohol or drugs, Houston personal injury attorney Brad T. Wyly says.
“If you drive drunk or under the influence of an impairing substance, then you can also be sued for any property damage or personal injury you cause as the result of your reckless conduct,” says Wyly, the founder of the Wyly Law Firm, P.C., which represents drunk-driving accident victims in Houston and its surrounding communities.
“Victims of drunk drivers may be entitled to damages for past and future medical bills, pain and suffering, mental anguish, physical impairment, lost wages, lost earning capacity and disfigurement,” Wyly says. “For everyone involved, the consequences of drunk driving can be tragic. According to the Texas Department of Transportation (TxDOT), the state’s police departments and sheriff’s offices will participate in a two-week drunk-driving crackdown from August 20 to September 6.
During last year’s two-week crackdown surrounding the Labor Day holiday, law enforcement statewide worked nearly 18,000 combined overtime hours while focusing on finding and arresting impaired drivers, according to TxDOT.
In Texas, the legal limit for intoxication is 0.08 BAC (blood alcohol concentration), and it is illegal for a minor to have any detectable trace of alcohol in their system. If convicted of drunk driving, a first-time offender faces up to 180 days in jail, a $2,000 fine and loss of their driver’s license for up to one year. The driver’s insurance premiums typically increase as well.
The consequences of drunk driving can be much greater than jail time or fines, Wyly says, pointing to statistics provided by TxDOT. In 2009, there were 27,108 alcohol-related crashes in Texas, causing 955 deaths and 17,542 injuries.
“Drunk driving can destroy the lives of accident victims, drivers and their families,” Wyly says.
Wyly suggests drivers call a taxi, designate a sober driver, use public transportation or call a friend or relative for a ride home as alternatives to getting behind the wheel while impaired.
“Anything is better than driving home when you are intoxicated,” Wyly says. “When you do that, you are a danger to yourself and to everyone else on the road.”

Rat Bite Draw Lawsuit
Philadelphia, PA – A Philadelphia man has filed a personal injury lawsuit against a Dollar Tree store at the Penrose Plaza in Southwest Philadelphia for a rat bite he sustained while inside the store, as reported by The Philadelphia Enquirer.
Bernard King claims he was shopping in the store for ribbon to wrap a birthday present for his granddaughter when he reached into an open ribbon box on a shelf and pulled out a rat. According to King, the rat bit his right index finger and held on as he tried to dislodge it.

BP Sued for Cleanup Dispersant
The energy giant has sprayed 1.8m gallons of Corexit into the sea to break up the oil released when its Deepwater Horixon rig exploded and sank, killing 11 men.But the practice was strongly criticised over a lack of scientific studies into it effects and the manufacturer's reluctance to reveal the product's chemical make-up.
The class action suit related to Corexit could potentially unleash a new wave of litigation, as BP already faces more than 300 claims over economic hardship, environmental damage and alleged safety breaches.
It has been filed in Alabama against BP and the chemical's maker, Nalco, by Glynis Wright and Janille Turner, two Gulf Coast residents, alleging that Corexit 9500 is "four times more toxic than sweet crude oil".
They are seeking compensation for "negligence and wanton misconduct, as well as nuisance, trespass, battery and medical monitoring".
The claimants also argue that "the toxic dispersants were used deliberately to lessen the financial burden on the defendants and lessen public reaction to the oil spill".
Scientists from the University of Southern Mississippi's Gulf Coast Research Laboratory last week found that the substance has now "probably" entered the food chain following tests on crab larvae.
However, little is known about the consequences of releasing the chemical on such a large scale.
A safety sheet produced by Nalco concludes that Corexit's "human hazard potential is low" but also admits that "no toxicity studies have been conducted on this product".
The same document notes that while ingestion is "not a likely route of exposure" the chemical "may cause nausea and vomiting [and] can cause chemical pneumonia if aspirated into lungs".
Corexit did not pass tests in the UK and was banned from being used to tackle oil spills in 1998. However, it was approved for use by the US Environmental Protection Agency, after BP argued that this was the only suitable chemical to help get rid of
the oil.
The class action suit is being handled by Beasley Allen, the law firm that extracted $11.8bn (£7.4bn) from ExxonMobil over its Alaskan oil spill – later reduced to $2.5bn.
The firm has also filed a number of suits in Alabama, Florida and Louisiana seeking compensation for economic hardship caused by the spill, including businesses losing revenue and homeowners who have lost value on their properties.
"BP is using these dispersants at an unprecedented rate not seen in other oil disasters," said Rhon Jones, head of Beasley Allen's toxic torts division.
"What you are seeing is a company that is doing anything to keep the oil out of sight and out of mind. They are using these chemicals close to the shore, and predictably, people are starting to feel the effects."
A group of scientists led by Dr Susan Shaw of the Marine Environmental Research Institute has opposed the use of the chemical on the grounds that its effects are unknown.
"We believe that Corexit dispersants, in combination with crude oil, pose grave health risks to marine life and human health, and threaten to deplete critical niches in the Gulf food web that may never recover," she said.
A BP spokesman declined to comment on the lawsuit, but emphasised that the use of all dispersants was approved by America's National Incident Command and the EPA.
The latest controversies over BP's use of dispersants has put a dampener on government scientists' declaration that 75pc of oil in the Gulf is now gone. And it is another headache for the oil giant's lawyers as they fight a tenfold increase in legal action following the spill.
BP was also hit with an unrelated $10bn suit in Houston last week linked to the alleged leak of chemicals at its Texas City refinery in April and May.
Local media in Texas reported on Friday that 3,400 people queued round the block of the Houston law firm handling the case to join the 2,200 existing claimants in the action.
The class action suit related to Corexit could potentially unleash a new wave of litigation, as BP already faces more than 300 claims over economic hardship, environmental damage and alleged safety breaches.
It has been filed in Alabama against BP and the chemical's maker, Nalco, by Glynis Wright and Janille Turner, two Gulf Coast residents, alleging that Corexit 9500 is "four times more toxic than sweet crude oil".
They are seeking compensation for "negligence and wanton misconduct, as well as nuisance, trespass, battery and medical monitoring".
The claimants also argue that "the toxic dispersants were used deliberately to lessen the financial burden on the defendants and lessen public reaction to the oil spill".
Scientists from the University of Southern Mississippi's Gulf Coast Research Laboratory last week found that the substance has now "probably" entered the food chain following tests on crab larvae.
However, little is known about the consequences of releasing the chemical on such a large scale.
A safety sheet produced by Nalco concludes that Corexit's "human hazard potential is low" but also admits that "no toxicity studies have been conducted on this product".
The same document notes that while ingestion is "not a likely route of exposure" the chemical "may cause nausea and vomiting [and] can cause chemical pneumonia if aspirated into lungs".
Corexit did not pass tests in the UK and was banned from being used to tackle oil spills in 1998. However, it was approved for use by the US Environmental Protection Agency, after BP argued that this was the only suitable chemical to help get rid of
the oil.
The class action suit is being handled by Beasley Allen, the law firm that extracted $11.8bn (£7.4bn) from ExxonMobil over its Alaskan oil spill – later reduced to $2.5bn.
The firm has also filed a number of suits in Alabama, Florida and Louisiana seeking compensation for economic hardship caused by the spill, including businesses losing revenue and homeowners who have lost value on their properties.
"BP is using these dispersants at an unprecedented rate not seen in other oil disasters," said Rhon Jones, head of Beasley Allen's toxic torts division.
"What you are seeing is a company that is doing anything to keep the oil out of sight and out of mind. They are using these chemicals close to the shore, and predictably, people are starting to feel the effects."
A group of scientists led by Dr Susan Shaw of the Marine Environmental Research Institute has opposed the use of the chemical on the grounds that its effects are unknown.
"We believe that Corexit dispersants, in combination with crude oil, pose grave health risks to marine life and human health, and threaten to deplete critical niches in the Gulf food web that may never recover," she said.
A BP spokesman declined to comment on the lawsuit, but emphasised that the use of all dispersants was approved by America's National Incident Command and the EPA.
The latest controversies over BP's use of dispersants has put a dampener on government scientists' declaration that 75pc of oil in the Gulf is now gone. And it is another headache for the oil giant's lawyers as they fight a tenfold increase in legal action following the spill.
BP was also hit with an unrelated $10bn suit in Houston last week linked to the alleged leak of chemicals at its Texas City refinery in April and May.
Local media in Texas reported on Friday that 3,400 people queued round the block of the Houston law firm handling the case to join the 2,200 existing claimants in the action.

Singer Wants Compensation After Falling 2 Stories at the Opera

A male opera singer is seeking personal injury compensation amid claims that an accident he was involved in while performing has prevented him from working.
David Montague-Rendall had travelled to Denmark to sing in Aida at the Copenhagen Opera House when the incident occurred in April 2005, the Bournemouth Echo reports.
He was taking part in a key scene when the two-tier set suddenly collapsed, causing him to fall 15ft.
Mr Montague-Rendall's left hip was shattered and his shoulders were badly hurt in the fall. He also only managed to avoid being crushed after quickly crawling to safety straight afterwards.
The 61-year-old had to be treated in hospital and although he has now recovered thanks to multiple joint replacements, he insists he is no longer able to perform to the same standards he could achieve before the accident and has consequently not worked for two years.
Mr Montague-Rendall is seeking compensation of GBP 250,000 from the Danish Ministry of Culture to cover his lost earnings.
The victim's legal representative said although the organisation has admitted liability for the accident, it is disputing the extent of damage sustained and the case will therefore go to court to decide if Mr Montague-Rendall will be remunerated.
Anyone who is hurt in an accident while working abroad should seek specialist legal advice as soon as possible if they believe they may be entitled to compensation as a result of negligence.
It may be wise to take photographs of the accident site and to record it in a log book to assist with the case.

Wood Shop Accident Gets Law Suit in Los Angeles

Lawyers Advocate to Stop Duck Boat Tours
The tour boats have "serious safety flaws" and are "even more hazardous" when in the Delaware's busy shipping channel, asserted the lawyers, Holly Ostrov Ronai and Robert J. Mongeluzzi.
They urged the U.S. Coast Guard and the City of Philadelphia "to immediately impose a moratorium" on duck-boat service in the river.
A tour-boat operator, Ride The Ducks, has voluntarily suspended local operations since a July 7 collision between a disabled duck boat and a barge in the river near the Benjamin Franklin Bridge. The accident killed two Hungarian students who were passengers in the amphibious vessel.A decision on the future of duck-boat tours ultimately rests with Coast Guard Capt. Todd Gatlin, who oversees river traffic in the Philadelphia area, said a Coast Guard representative.
"The Coast Guard will continue to work closely with Ride the Ducks and the City of Philadelphia to ensure that all safety issues related to the operations of the vessel are addressed," said Petty Officer Crystal Kneen.
The Coast Guard also is taking part in an investigation into the recent accident by the National Transportation Safety Board, she said.
A Ride The Ducks representative could not be reached Friday. The Georgia-based firm's website notes its 90-plus duck boats are inspected annually by the Coast Guard.
The firm also says it has Coast Guard approval for two vessels of its own design -- the 1999 "stretch duck" and the 2006 "truck duck." It was not known whether the boat that sank, called Duck 34, was one of those models.
The 35-foot duck boat, with 35 passengers and two crew members, sank quickly after it was hit by a 250-foot barge. The duck boat's captain has said his distress calls drew no response from the crew of a tugboat pushing the barge upriver.
The tugboat's pilot has declined to talk to investigators, citing his right against self-incrimination.
In a statement, Ronai and Mongeluzzi asserted the local duck boats "do not have sufficient reserve buoyancy to remain afloat in the event of flooding and have canopies which are well known to cage passengers attempting to escape."
They noted the NTSB, in a report on a May 1999 duck-boat sinking that killed 13 people on an Arkansas lake, said the "natural buoyancy of passengers' bodies forced them into the overhead canopy, which acted like a net to entrap them."
The lawyers' statement noted Duck 34 had a canopy, but it did not directly address the circumstances of the students' deaths. The attorneys, who are a preparing a civil lawsuit over the accident, did not return a call seeking additional comment.

Wikileaks May Spawn Personal Injury Lawsuites
A former Navy lawyer, now a civil litigator, predicts that the massive WikiLeaks document dump will be “a gold mine” for personal injury suits against war-zone contractors.
“I see this database as a real resource for U.S. plaintiffs’ lawyers who are already trolling for potential clients -- anyone who is named as having been injured, service member families who happen to reside in their state, etcetera,” Tara Lee, a partner at DLA Piper, which represents aerospace and defense contractors.
“To a personal injury plaintiffs lawyer, those are all potential clients in a tort suit against a contractor,” she said. ”So, for the ambulance chasers of the battlefield, the WikiLeaks database is a goldmine.”
The lawyers aren’t necessarily looking to get their clients their day in court, said Lee, a 1991 U.S. Naval Academy graduate. Far from it: Because of litigation costs, most defendants want to settle right away.
“Even for defendants who have done no wrong, what the plaintiffs' lawyers are often hoping for is a quick ‘nuisance value’ settlement,” Lee said.
Two firms specializing in personal injury suits did not respond to a request for comment.
But a third took sharp issue with Lee.
"I resent the implication that this leaked information provides any source of clients for plaintiff lawyers,"Tommy Fibich, founding partner of a Houston law firm that specializes in civil litigation.

Arbitration isn’t a cheap alternative either, as the families of four Blackwater contractors who were captured and killed by insurgents in Iraq in 2005 can attest.
In early July the Virginian-Pilot newspaper reported that “in the latest twist in the long-running case, the arbitration proceedings have been terminated over nonpayment of fees and expenses to the arbitrators.”
They are trying to get the case back in court in North Carolina, the paper said.
“I see this database as a real resource for U.S. plaintiffs’ lawyers who are already trolling for potential clients -- anyone who is named as having been injured, service member families who happen to reside in their state, etcetera,” Tara Lee, a partner at DLA Piper, which represents aerospace and defense contractors.
“To a personal injury plaintiffs lawyer, those are all potential clients in a tort suit against a contractor,” she said. ”So, for the ambulance chasers of the battlefield, the WikiLeaks database is a goldmine.”
The lawyers aren’t necessarily looking to get their clients their day in court, said Lee, a 1991 U.S. Naval Academy graduate. Far from it: Because of litigation costs, most defendants want to settle right away.
“Even for defendants who have done no wrong, what the plaintiffs' lawyers are often hoping for is a quick ‘nuisance value’ settlement,” Lee said.
Two firms specializing in personal injury suits did not respond to a request for comment.
But a third took sharp issue with Lee.
"I resent the implication that this leaked information provides any source of clients for plaintiff lawyers,"Tommy Fibich, founding partner of a Houston law firm that specializes in civil litigation.
